1. General Provisions and Purpose
These Terms and Conditions (the “Agreement”) govern the use of all services (the “Service”) provided by [Site Name] (hereinafter referred to as the “Company” or “Site”). The purpose of this Agreement is to define the rights, obligations, and responsibilities between the Company and its Members concerning the use of the Service, as well as general operational rules.
Compliance and Amendments:
- This Agreement becomes effective upon its public notice to the user.
- The Company may revise this Agreement within the scope of not violating relevant laws, such as the Act on Consumer Protection in Electronic Commerce, the Regulation of Terms and Conditions Act, and the Act on Promotion of Information and Communications Network Utilization and Information Protection.
- Matters not specified in this Agreement shall be governed by relevant laws or commercial practices.
2. Definitions
The key terms used in this Agreement are defined as follows:
- Site: The virtual business place or website (e.g., https://aicomming.com/) established by the Company to provide services or goods to users. This term also refers to the business operator managing the site.
- Service: All internet-based services provided by the Site to Members and Non-members, including information provision, community activities, and product sales.
- Member (User): A person who enters into a service contract with the Company under this Agreement and uses the Service.
- Non-member: A person who uses the Service provided by the Company without having registered as a Member.
- Post/Content: Any form of information, including text, photos, files, and links (such as symbols, characters, voice, sound, images, or videos), that a Member posts on the Service.
3. Service Usage and Contract Procedures
① Service Application and Contract Formation
- The Service Use Contract is concluded when a person who wishes to become a Member (hereinafter, the “Applicant”) agrees to the terms of this Agreement, completes the membership application form specified by the Company, and the Company accepts the application.
- The Company may refuse to accept or later terminate the contract for applications that fall under any of the following:
- If the Applicant has previously lost their membership status under this Agreement (except in cases where the Company grants permission for re-registration).
- If the application contains false, omitted, or incorrect information.
- If acceptance is deemed difficult due to the Applicant’s fault.
② Contract Termination and Withdrawal
- A Member may request termination (withdrawal) from the Company at any time, and the Company must process this immediately as prescribed by relevant laws.
- If a Member falls under any of the following, the Company may restrict or suspend the membership status, and may lose the membership status if the same act is repeated twice or more, or if the reason is not corrected within 30 days:
- Illegally using or stealing another person’s personal information or interfering with the Service use.
- Committing acts that violate the law or this Agreement, or acts contrary to public order and morals.
4. Service Provision, Changes, and Suspension
① Service Content
- The Company provides services to Members such as [Specify Main Services, e.g., Blog Posting, Community Forums, Online Product Sales].
② Service Changes and Suspension
- The Company may change or suspend all or part of the services due to operational or technical necessities. In such a case, the Company will notify the Member via a notice on the Service screen or by email.
- The Company shall not be liable for any damages incurred by the Member due to the change or suspension of the Service unless there is intent or gross negligence on the part of the Company. (However, for paid services, compensation will be made according to relevant laws.)
5. Obligations of Members (Users)
Members shall not engage in any of the following acts:
- Illegal Reproduction/Copyright Infringement: Any act that infringes upon the Company’s copyrights and other intellectual property rights.
- False Information: Registering false information when applying for membership or changing information.
- Identity Theft: Stealing or misusing another person’s name or personal information.
- Transmission of Advertising Information: Transmitting or posting commercial advertising information for profit without the Company’s consent.
- Defamation/Slander: Damaging the reputation of the Company or others, or interfering with business operations.
- System Interference: Interfering with the sound operation of the Service through hacking or the distribution of computer viruses.
- Other Legal Violations: Any other act that violates relevant laws and regulations.
6. Obligations of the Company (Operator)
The Company has the following obligations:
- Service Provision: The Company must strive to provide continuous and stable services as stipulated in this Agreement.
- Privacy Protection: The Company must protect the personal information of its Members and adhere to the Privacy Policy. (Detailed matters follow the separate Privacy Policy).
- Fair Advertising: The Company must comply with the Act on Fair Labeling and Advertising regarding the labeling and advertising of goods or services.
- Security System: The Company must establish security systems and take technical protection measures to provide a safe service.
7. Management and Copyright of Posts
① Rights and Responsibilities for Posts
- The copyright of the Post uploaded by the Member to the Service belongs to the author of that Post.
- The Member who created the Post is solely responsible for all legal issues (such as copyright infringement, defamation, etc.) arising from the Post they uploaded.
② Use and Deletion of Posts
- The Company may reproduce, display, transmit, or distribute the Member’s Post for non-commercial purposes, such as service operation, promotion, and improvement, and may utilize them until the Service is terminated.
- The Company may delete, move, or refuse to register the Member’s Post without prior notice if it determines that the Post falls under any of the following:
- Infringing upon the rights (such as copyrights) of others.
- Containing obscene or violent content, or content contrary to public order and morals.
- Containing commercial advertising content for profit.
- Otherwise deemed to violate laws and regulations or this Agreement.
8. Disclaimer
The Company shall not be held responsible for damages incurred by the Member due to the following reasons:
- Force Majeure: Temporary suspension or delay of service provision due to acts of God or other irresistible forces such as war, riot, government regulation, or natural disaster.
- Member’s Fault: Obstruction or damage to service use due to the Member’s intentional or negligent fault.
- Communication Failures: Damage caused by a key telecommunication business operator suspending or failing to provide telecommunication services normally, as defined by the Telecommunications Business Act.
- Reliability of Information: The reliability and accuracy of information, data, or facts posted by the Member on the Service.
- Transaction Liability: Losses arising from transactions between Members, or between Members and third parties, mediated through the Service.
9. Dispute Resolution and Jurisdiction
① Dispute Resolution
- The Company prioritizes handling complaints and opinions submitted by users. If prompt handling is difficult, the Company will immediately notify the user of the reason and the processing schedule.
- In the event of a dispute related to electronic commerce between the Company and the user, the user may apply for relief to the Fair Trade Commission or follow the mediation of a dispute mediation institution commissioned by the city/provincial governor.
② Jurisdiction
- Any lawsuit filed between the Company and the user shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Company’s location (e.g., Seoul Central District Court).
